Captain found guilty, dismissed from Air Force Published Nov. 12, 2010 39 Air Base Wing Judge Advocate INCIRLIK AIR BASE, Turkey -- A captain assigned to the 39th Air Base Wing here was tried in a general court-martial held Oct. 19-21 at Scott Air Force Base, Ill. Capt. Gerald D. Harvey pleaded guilty to all charges and specifications and was sentenced to a reprimand and dismissal from the Air Force. Captain Harvey was charged with one specification of failure to obey an order, in violation of Article 92 of the Uniform Code of Military Justice, for sending sexually explicit e-mails on a government e-mail system; one specification of dereliction of duty, in violation of Article 92 of the UCMJ, for having an inappropriate relationship with a woman he was counseling as a chaplain; one specification of conduct unbecoming an officer and gentleman, in violation of Article 133 of the UCMJ; and one specification of having sexual intercourse with a married woman who was not his wife, a violation of Article 134 of the UCMJ.
